Indian contract validity on onsite deputation - i am working on japanese land?
I am an employee of an indian company deputed in japan. they have a subsidiary in japan and i have been sent as an intracompany transferee. i have a valid japan work permit. my contract in india has a notice period of 90 days but as per japanese labour law the notice period is 30 days from both sides. i read somewhere that if you are working on any country on a valid work permit the local laws supersede any contracts made anywhere else. now my question is will my notice period be 90 days because i am still an employee of the indian company and the original contract is still valid? or will it be 30 days as per japanese laws because i am working on japanese land?

Hi could you let me know how to draft a no objection clearance certificate if a person is on a work permit for a company and the company has no objection in the employee working for any other employer on their permit as long as they work in the same profession field please let me know what to include as this letter has to be sent to the home office as well hope to hear from you soon thanks

Hi just to give an intro i worked for company a 5 years in india. then i joined company b indian company in usonsite almost 1 1/2 year back. so when i left company a i had pf account because i was on indian payroll. now i m in usd payroll company b. not enrolled in indian pay. i was told by hr from company a whether i can close the pf and get the money. as per them following are the 2 options. > for a withdrawal i need to provide a declaration letter stating that you will not be working in any other company since as per the pf new rules need to provide > 2nd option is transfer. otherwise they won t be able to process. if both the option is not possible amount will remain in the my account. as per above i cannot go for option a because i cannot declare i won t join/work for any company. also i can t choose option b because i m not in indian payroll. no new p/f account to transfer. how long the pf office will keep the money in my account ? i would really appreciate if could someone please let me know if there are any new pf rules about this declaration letter. regards bala
