There is the possibility that the school authorities may have cited any clashing maternity benefits between the maternity benefit act and the esi act. But I doubt if this should affect the right to maternity leave. If you are covered under ESI, it may be good to visit the nearest ESIC office and check with them on whether any provisions under the ESI act deny you the benefit of maternity leave.
If you are not covered under ESI, but still find yourself eligible as having worked for more than 84 days as an employee with the school, then it would be good to check with the school authorities, on whether they have any exemption under the maternity benefit act with regard to the nature of establishment or number of employees.
Our school is an unaided recognised private school by directorate of education, Delhi and affiliated by CBSE also. Total number of permanent staff is 18 and 20 contractual staff. They are saying that we have not given paid maternity leave to any of the employee and we have not sufficient fund But currently we are taking salaries according to 7 pay.
Fund is immaterial. Find whether delhi govt has extended MB Act such school as a class of establishments. Only then it is applicable.
