I have just joined a new IT company which is in its start-up phase, I need to design Medical leave policy, they don't have any HR policy there.Now, in my new company they want me to design medical leave policy ,one of our employee took medical leave for a month(he is been in our company from past 7 months, can anyone help how to frame medical leave policy in this case (is he eligible to get paid or not....?) kindly help.
For leave entitlement for employees please follow as per Bengaluru Shops and Establishment Act. Any thing sanctioned beyond what is stated in Act is employers discretion.
If an employees avails sick leave beyond his entitlement, subject to genuity of the case try to adjust it against all his leave balance (SL/CL/PL or EL). Beyond which naturally it has to be Leave without pay.
