Esi v/s employee compensation act applicability
Where an employee is covered under esic act whether workmen s compensation act is applicable to him? a: no. there are some places where esic is not available. wc act 1923 is applicable there. 1let us have the concrete provision about ' the employee not covered under esi has to be covered under employees covered under employee compensation act' 2 definition of employee under amended pl share the concrete provision. if anybody had a ppt to show the diffrence considering the various amendments under both the acts. regards.

Our factory is covered under esic and few of workers involved in the manufacturing process are out of the esic coverage because of their wage more than 15000 pm. and under sub section 3 of section 10b of workmens compensation act1923 chapter ii whereby there is specific denial of applicability of wc to the factories to whom esic is applicable. my question is if any accidental death happens inside the factory and esic benefit is not applicable due to wage more than rs.15000/ pm and also factory is outside the perview of workmen s compensation act 1923 will any other law applies for this please clarify.

If one contract labour who is covered under esi act 1948 and died while in duty electrical operation is also entitle to get the benefits under employee compensation act 1923? if not then apart from the funeral benefits and family pension under esi act what are the other benefits his legal heirs are entitled to receive?
Esic/wc under for construction workers
Dear all seniors i have one query related esic applicable on construction worker . my factory is covered under factory act 1948 and now we are constructing one more building in same premises through contractors and he has engaged around thirty labour for new building construction in which 10 people are permanent type labour and rest they have engage through daily market labour which are changed everyday . contractor have his own esic no and but taken esic no.s for only 10 permanent type his labours at site . rest labour are not covered neither esic nor under wc act 1923 pls suggest what to do for cover all construction worker in case accident . pls advice if esic is applicable to our factory then we/contractor can also opted wc policy for construction workers parallely in our area all companies are coverable under esic . regards ps
Employee's compensation act, 1923
Hi we are having large number of employees in our organisation. almost all our employees are out of the purview of the esi act 1948. we have covered them under personal accidnet policy with one insurance company. the benefit which is the outcome of this policy are much better than the benefits mentioned in employee s compensation act 1923. further our one plant is situated in non implemented area and hence employees of that plant is not covered under esi act. considering this background can we apply for an exemption from the provisions of the employee s compensation act 1923 ? request you all concerns to give your inputs on this. regards omkar
