As you are aware, on behalf of various sectors of industry and trade, we have filed Writ Appeals before the Divisional Bench of the Hon’ble High Court of Karnataka challenging the order of the Lower Bench and validity of Minimum Wages Notifications, which were upheld in the Writ Petition Order dated 29.03.2019.
All the Writ Appeals were posted on 05.08.2019 for preliminary hearing and we presented the case. Further, the matter was heard on 06.08.2019 & 07.08.2019.
When the matters were called out, we have made submissions on the Appeals on behalf of parties to the Writ Appeals. Appreciating the merits in the Appeals and also in the submissions, the Hon’ble High Court on 07.08.2019 has directed (orally) the State Government “Not to precipitate enforcement of Minimum Wages Notifications during the pendency of the Appeal”.
Further, the Hon’ble Divisional Bench of the Court has expressed its intention to hear the issues which were argued before the Single Judge, Lower Bench, but not considered. For the same, the Hon’ble Court has sought consent of all the counsels appearing for stake holders.
Now, the matters are adjourned to 16.08.2019 for further hearing and in the meanwhile parties are given liberty to file written arguments and synopsis.
