have a query regarding an employee joined a competitor company after quitting his current job. One of my friend has resigned from his current employer. He got a mail from the company for explanation mail within 48 hrs as per the offer letter there is clause that after leaving the company he won't be able to join in any similar company before 2years if he done that he need to pay 24 months salary as compensation. He have a 15 years of working experience in his field company has giving a promise for the promotion from last 3 years on wards and last movement they destroying the same this year also they done the same .Is there any possibility of such a situation arising. Can a legal case be filed against him for joining a competitor firm? Please help me he joined a new company 2months back only.

As of now, there is no need to file a legal case as such. Just show the newspaper clipping to HR and that too if they ask for. Tell him to keep quiet until he receives a notice from his past employer.
Lastly, the spelling and grammar of your post. It is far from satisfactory. There are a large number of members who hold pride in quality writing. Possibly you could have thought of what jarring feeling they could get while reading the post. Therefore, the request is to maintain the professional standard of your posts.
