Hello everyone.. I joined my present college as teaching faculty on April 1st 2019. I will be proceeding for maternity leave on August 30th 2019. When I asked my hr for maternity benefits as I have completed 80 days of work the HR denied saying I need to work 2 yrs in the college to avail it. But my colleague who earns less than 21000 is granted esi maternity benefits.. Does that mean just because I earn 22000 a month am deprived of the benefits??? Dont I too have to care for my child for 6 months???

Yes. You are eligible for Maternity benefit. It is statutory and employer cannot deny it. For ESI category they are offering MB through ESI which means they are bound to follow MB benefit to employees.
You can explain your HR that as per MB Act you are eligible and no where it is mentioned 2 years working as criteria.

Hi, First try to resolve within the college HR level to a maximum extend. Mostly when these issues get aggravated this will get changed as ego clash and they will try use their influence and they will try to challenge all your efforts. Instead of NCW I would suggest you to contact Labour Officer of your jurisdiction first and in case if your were not able to succeed then NCW.
