Dear All, We have one employee who has completed 21 days out of 90 days of notice, how much he will get his gratuity, leave encashment and how much he will get his salary.
His details are:-
Basic:7131
Annual leave balance =74
Date of joining : 1may 2009 and left on 16 april 2019.

Hi,
Gratuity depends on his final Date of relieving. Last drawn basic salary x 15/26 x number of years completed.
Notice period is employers internal and shortfall in notice period can be recovered from his FFS provided you have that clause in the appointment order ( either 3 months notice or salary in lieu of notice).
Leave encashment - based on number of leave in credit as on date of his relieving.

Dear Friend, Leave encashment calculates on Gross, and salary calculation as you do on Gross/31*21 and deduct his statutory.

The employee have to complete notice period, if not the shortfall days to be deducted from the leave remained balance in his account;
In the instant case if not completing 68 days to be deducted from his leave in balance i.e. (74-68).
Leave encashment for 6 days=Rs. 1426/
Salary for 16 days on gross.
Gratuity: 9 yrs 11 month 15 days @ 7131 is Rs. 35655/-

Basic Salary of Rs 7,131/-PM is less than Applicable Minimum Wages? can you please let us know the reason for academic interest

Deart Concern,
what if he doesn't have enough leave, i.e here he has 74 leave, but what f he has only 30 leaves ?
Than from where should we deduct the amount, can it be deducted from gratuity ?
