I am working with an organisation who are growing. yet no any good policy for staff. all are common policy for worker and taff.
the company is not providing and paid holiday or diwali vacation as well. in diwali month we got unpaid leave only ! there is no medical leave, casual leave or sick leave as well. all leave are treated as unpaid leave. I want to know more about this situation. what LAW and professionally says. whenever I rise complain about this they refuse my complain and told me you are working in factory not in office. by the way I am assi. hr officer !
what I can do in this situation ?

This case is a pathetic one. Requires to be taken to labour/civil court for unlawful labour practices. There is no less provision in a "Factory" than an "office" . And every factory admin should adhere to the provisions of Factories Act. You being an HR officer you know the provisions of law and how is that you chose to ask our suggestions for all your non-compliance. A factory running without a 'paid holiday' is horrible, never heard of in my life time and whosoever avails has to go without pay is condemnable. How such an admin can be tolerated in democratic India. Where is this factory located?.
Seriously, you as HR should take it up in right earnest strongly, as a service to poor, exploited lot of workmen of your unit without delay anymore.

one thing I forget to write is we are getting Earn leave only. we get 1 earn leave on every 20 working day.
except that we did not get any paid leave even not on republic day or Gandhijayanti !
whenever the public holiday found in calendar they move our weekly off on that holiday and said we avail you a HOLIDAY !
is there any strict provision to stop such activity ? Is it compulsory to provide paid Medical leave or Casual leave or Sick leave to employee ? if yes how many ?

In which state your factory is located? How many employees, don’t you have a Union?

Sir, factory located in Mehsana District of GUJARAT State 2700+ Employee. no union.

The factories act covers all those points you raised in this discussion. As per the factories act only you are eligible for earned leaves @ 1 day per 20 working days. All other leaves are sanctioned by the management with understanding with union or workmen forum. You ask your management to provide a copy of Standing Order and as per the law your company should have since workmen strength is more than 100.
You can raise the complaint before the Factory Inspector or before the Authority of labour Department where your factory exists.

Since no Union,, silently educate some workmen, who seem with leader qualities.. They will get you leaves!!!

It's possible to raise an Industrial Dispute if the unit is covered under the ID Act. It's suggested employees either jointly register a Trade Union or association under Trade Union Act and represent your grievances to ensure fair labour practices as per law.
