Hello. We are a company manufacturing textile machinery. We propose to have a contract with a contractor for job work basis / piece rated basis. These workers shall be coming into our factory premises. The number of workers shall be flexible and depend on the contractor considering the assignment given by the Company. In such a case, I have the following questions:
1. Will the Company be considered as a principal employer?
2. Will the Company have to comply with ESI and PF liabilities?
3. Will this be termed as a contract for job work or contract for manpower and service?
