Dear all there is a term called dismissal/termination simpliciter. i wanted to add this clause in hr manual of our organisation. therefore i request your expert suggestion and details description of the same.
Confidentiality clause in employee manual valid after resignation ?
Please give your valuable comments. n organization enters into a confidentiality agreement with customers. but the company does not have a separate nda with employees and may face some resistance if a nda is now initiated with existing employees. the employees are given an handbook / manual a kind of policy manual at the time of joining. the manual contains a confidentiality clause e.g. exclusive customer related information received should not be disclosed even after resignation. the employee signs in duplicates and a signed copy of employment manual is with hr. the ill the he / she be bound by this clause after leaving the company and joins with a competitor? whether the company can initiate legal action on the basis of this clause? please clarify. sambasivam
Clause in appointment letter regarding not serving notice period by employee
We have clause in appointment letter " 1 month notice period from either side" can we add other clause stating the consequences in case notice period is not served?? like no remaining payment and no experience letter etc.?? please suggest. regards hr

Pemanent employee's termination without assigning any reason
I was working in a public sector bank in officer cadre. all of a sudden my services were terminated without assigning any reason. i was working in this provincial bank for last 18 years. the bank also paid me 3 advance salaries in lieu of three month notice. as per my appointment letter there is no such clause for termination of services without any reason. there is only one clause that speaks about the service rules is as under: " after joining the bank you will be called upon to sign the service rules of the bank when framed." the intresting thing is that no body in the bank know where are the bank s service rules. neither these are circulated nor signed by any employee. in my termination letter only reference is given to hr manual clause. i did not even see this manual. this manual is also not circulated and i did not signed on its acknowledgement. there is also a gratuity scheme in bank. please guide me in this matter. i am planning to go to the court. in my point of view bank will take the plea of master servant relationship. is there any court verdict on this type of illegal termination
