i joined a pvt company named BOP PT LTD. in may 2013, suddenly in oct 2015 they have internally transferred some employees in theis newly established sister concern bayaweaver ltd. while transferring they ask us to withdrawl our pf of BOP PVT ltd, since than i was working there. from last 3.5 years suddenly yhey ask me to leave for unknown reasons without giving any written notice/intimation. when i asked for my gratuity they refuse d by saying that you were transferred in ither establishment hence not eligible for gratuity.
from last six years i never resigned or been terminated only they gave me a new appointment letter after some time of transferring in which my CTC was also reduced.
now i must tell you that we all employee have working official email IDs of both the companies, even after transfer all the corporate communication done by HR on old companies email id from his old email ID. all the employees were using old emails for a long time since transfer.even our CUG nos. are still same all the more or less management is also same, both the companies are handled by same person some from inside company & some from outside company.
so please help me getting right info on that !!!!!!

Hi,
At the time of transfer to sister concern, you should have requested for continuity certificate from your Employer. Please clarify whether you received any official transfer order or any official communication from your initial employer . Its employer specific and if they have created documents as two fresh appointment then you can't claim. You may request with any proof which is available with you as proof of transfer.

no, there is no pre intimation of transfer, we came to know in feb when management asked to withdrawl PF. & after a long time they handed over the appointment letter. for transfer.
