I had joined a company in nov 2018. At that time i was unaware of my pregnancy. My due is in July. Post feb 2019 i got to know my company is not having any maternity policy and now in April 2019 i am asked to resign as they cannot afford to either pay me for maternity or allow me leave without pay. Please suggest.

Dear Friend,
1.wherein 10 or more persons are working on any day of the preceding 12 months then this act applies.
2.The employee should have worked for her employer at least 80 days in the last 12 months.
3. Employee can avail the benefit of 26 weeks.
If any employer fails to pay any amount of maternity benefit to a woman entitled under this Act or discharges or dismisses such woman during or on account of her absence from work in accordance with the provisions of this Act, shall be punishable with imprisonment which extend to 1 year or with fine which may extend to Rs. 5000 or with both.
