Our company is into manufacturing & supply of turnkey sugar plant machinery. Our head office is located in Mumbai area with 25 employees in head office. We have policy of one year probation period for all employees. One of our female employee joined in Sept 2018 and till March 2019 she availed more than 26 days of leave mentioning the reason of ill health & brother's marriage. Now management is not happy with her poor attendance & also about her performance. From 04th April 2019 she is again on leave & intimated us that she is pregnant & doctor has advice her to rest till further notice. so now she is not able to come office & even not sure whether after resuming duty how long she will again work.
Terms & conditions of her appointment letter says: -
"Probations & Confirmation - In the first instance you will be on probation for a period of one year from the date of your joining, where after the probation period may be either extended at the discretion of management or may be dispensed with either earlier or on completion or thereafter till confirmation. Unless confirmed in writing, you will be deemed as probationer after the expiry of the initial or extended period of probation. Your services are liable to be terminated without any notice or wages in lieu thereof during the initial or extended period of probation. However, after confirmation of appointment, your employment is terminable either by the company or by yourself by giving one month’s notice in writing or payment of Basic salary in lieu of such notice".
In this case, As she is in probation please share me the format to intimate her positively that management is not happy with her poor attendance & decided to terminate from her services.
