I am working in my company since past 2 years, it is a real estate company, there is an employee who is working since past 1.5 yrs. Management told me not to give offer and appointment to that employee as he is not performing since past 6 month. and from past 2 months his salary is on hold. Now he is threatening me that he will file a case against me.

Record of Employment against a Permanent Post in any Esta includes, His/Her Name on its Muster-Roll + Daily Attendance Recorded in Esta's Office Attendance Systems, Entry Prmit/Gate Pass, Wages/ Salary paid, Deduction of PF etc even in cases, as your Where an Appropriate Format Appontment / Joing Letter / Record was not issued / created.
Plus, witholding Wages / Salry in itself amounts to a Very Serious Offence on te Part of your Employmnr/ Management,
For the Misconduct of Poor / Under Performance Proper Disciplinary Action -Step Need / should be initiated rather than indulging in Wrongdoing, Legally
