Gratuity eligibility 4 years and 190 days?
Sirs and madams i work for mnc company and till last day i completed 4 years and 11 months and 5 days. in the gratuity act said that for eligibility 4 years 190 days are required. for five days a week company last one year is equal to 190 working of continuous service. in that case i think i should be eligible for gratuity.am i correct? but my company says i must complete 5 years. so how can i convince them?if they disagree what action i can take?

Dear sir i have a query related to gratuity. i am working for it sector in chennai and got resigned. previously my company follows 4 years 190 working days rule and now it follows 4 years 240 calendar days rule to claim gratuity amount. my date of joining:15mar2013 my last date in company:15dec2017 i have worked for 4 years 9 month please let me know whether am i eligible for claiming gratuity amount according to 4 years 240 days rule and 4 years 190 working days rule?. awaiting for your kind reply

Hi all as per the gratuity act i see that 4 years and 190 days is sufficient for one to become eligible for gratuity in a company that works for less than 6 days. i have served for 4 years and 203 days in my company which works 5 days in a week. please clarify whether i m eligible for gratuity or not

Hi we have an exiting employee who has served the organization for 4 years and 6 months he has brought a paper from some lawyer giving calculation about gratuity of 190 days per year in place of 240 days. ours is the organization which works on alternate saturday off model. can somebody please guide if he is eligible for gratuity or not and how many days to be taken into consideration for calculation of gratuity; 240 days or 190 days. in case any verdict or court order you may like to share. i look forward to your help. regards manoj kumar anand anand.manoj.kumargmail.com
Payment of gratuity policy - section 2a mentioning 4 years and 190 days for a company operated 5 days per week?
Hi there is confusion about the gratuity policy eligibility. the company says the eligibility of 4 years 240 days or more of continuous service as the accepted one as per the "the payment of gratuity act 1972 the act". when i refer to the gratuity act online it says " section: 2a continuous service. a for the said period of one year if the employee during the period of twelve calendar months preceding the date with reference to which calculation is to be made has actually worked under the employer for not less than the section 2 a i 190 days 1 year if company operates 5 days/week. the section 2 a ii240 days 1 year in any other case if company operates 6 days/week. " is the above information correct? do we have such section 2a mentioning 4 years and 190 days for a company operated 5 days per week? if yes please guide me.. how to convey this to the hr and company. i am in it company
