Hi
I am in a complex situation where I worked for a company for 7 years in India and then they sent me to onsite for 5 years with condition that gratuity will continue in India
They transferred my payrole to its UK branch
They kept issuing me increment letters about increment of basic rate in india with condition if I join India back, it will be the increase basic
I worked for 5 years in UK and resigned in UK and did not go back to india
Now company wants to give me gratuity for 12 years ( 7 india and 5 for onsite deptuation) with calcuation based on my 5 years back basic salary and not the incremented basic as they say that you never joined back. but to my understanding they would have considered as payable basic. Even if the last paid basic then it would have been UK last paid (Though there is no basic component in UK payrole but only Gross)

Dear Sannu
This is a typical case, you need to go into details of what were terms and conditions, as you have said you were transferred on UK's company's payroll, was it considered as new joining/fresh joining or the company was different (must be different).
It is also surprised that the company is considering 12 years, including your UK stint. Was any amount towards Gratuity was being deducted from your salary?
May please seek clarification and rationale behind and take a pragmatic view.

Thanks fro responding to the message.
I was deputed to UK with continuation of my employment in India. And my company is considering 12 years for that
There was no amount deducted during my UK deputaion for Gratuity as there is the company's deputation policy for UK that the gratuity will continue in India along with other benefits in india like insurance for dependents etc for the deputed employees

Hi Sannu,
Greetings!!
Don't worry!! Its so simple to ascertain the same.
Ask to your parent co. that bifurcate your UK gross salary as per HO of Indian sub-continent salary structure.
So, your last basic will be there as of today.
Aftwards you can calculate as per stipulated standard calculation for Gratuity.

I am working in Manufacturing Association for last 10 years with the salary of Rs.10000/-. In my office we have 02 staff. We have Governing body and Executive Members. In our association we have 60 companies. I want to ask that whether I am eligible for gratuity.
