Dear Experts,
I would like to request your feedback on the following issue:
We have section 8 company and recently we have received a project for 2 years and it may extends according to requirement and performance of the project. For initiation and operations we have to take 45 people as our employee for the period. Now my concern is do we need to on-board them as consultants for these period or do we need to give them other benefits i.e. PF/ESIC since we are going to recruit more than 40 employees. But they will not placed in one location. Their Location may vary according to the requirement.

Any company registered u/s 8 of the Companies Act,2013 is a legal entity exclusively run for charitable purposes and as such exempted from certain laws like the Income Tax Act.. However, they are run with the systematic co-operation between the employer and employees only. Therefore its employees can not be deprived of social security benefits provided for by the ESI and EPF Acts.
