Dear all can anybody guide that if any principle employer having any employee s who have complete around 8 to 10 yrs continues under the varies contractor. 1 does he eligible to claim for permanent employment to principle employer...? 2 any employee working for such long time is it not prove that nature of work is not contractual in fact business requirement is permanent nature of job not as contract so is it not abolition under act..? or any provision on the same..? waiting for your advice. regards tushar swar.

Hello i am a officer in an government organisation. there are some contract labour working in our organisation since 1 year. now the contract has been closed because we have appointed a permanent employee in his place. contact labour was working for one year in one office only and he was doing the same job every day and he was reporting me directly and i was assigning him job everyday. contractor was not assigining any work him only we directly giving him job assignments. and now he has gone to labour court and filed a case against us for giving him permanent job. so now what we have to do now. regards satya malkangiri

Hello all i have 3 queries. 1 who is responsible for contributing the 4.75 employer contribution for esi. principal employer to direct employer in the case of a contract worker? 2 who is responsible for paying the premium and compensation for a worker s compensation policy in the case of a contract worker. principal or direct employer? 3 who is responsible for providing medical medi claim insurance to the contract worker in case the contractor direct employer doesn t have a medi claim policy for its employees. is it ok if we only ask them to get worker s comp. i m just concerned in case there is an illness that is non work related who is responsible for it and who pays for it? thanks n
