Did your Employer/Occupier of the Establishment set up in India, apply for and Obtained the Establishment Certificate after depositing the required Fees? If your answer is AFFIRMATIVE, you are an entity/ Establishment on India Soil and our Laws govern your Manager ( Occupier)/Esta and better Obey the Laws of the Land.
Likewise, your Employer is governed by the Sexual Harassment of Women at Workplace (P.P &R) Act 2013 and has to Discharge Duties of Employer under Section-19 & Section-22 failing which the Penalties under Section-26 shall be leviable also under the Companies Act.

Dear Cybersoftech,
According to the Companies Act,2013, any Company or body corporate registered outside India which has a place of business in India whether by itself or through any agency, physically or by electronic medium and conducts any business activity in India is a foreign company.
The Company should ensure compliance of applicable labor laws in respect of the employees employed in such branches.
Therefore, an emphatic " Yes" is the simple answer to your query.

Wonder why such basic doubt arose. Companies working in India have to perse follow all applicable Ind\an laws.
Thanks to all for the clarification.
