Unilateral payment option in notice period
Dear all i am working as sr. executive it is junior / middle level position in my organization in one of the engineering company having registered office in mumabi. i have resigned from my job and with one month notice against the three month notice in my appointment letter i have mentioned in my resignation letter that i ready to surrender my leaves as well as ready to pay the amount to compensate the shortfall in my notice period due to my early leaving. my office has denied my early reliving saying citing the clause in my appointment letter which is here under verbatim "thereafter your employment will be subjected to termination by three months' notice period on either side. the company however reserves the right to pay you three months' salary in lieu of notice." please guide me what action i can take for early reliving as my prospective employers can wait only for one month.
Notice period and earned leave settlements
Dear all could you please someone help to clear on this? issue is in my last organization they having 90 days as notice period for separation form the company and they have relived me before 11 days 7 working days from the actual last working date but i havent requested to the management for early reliving. during final settlements they have deducted 7 working days from the earned leave outstanding balance due to this i lost pay for 18 days 11 days early reliving 7 days from el. in other think if employees wants to relive before the actual last working day the company asked them to pay the salary to company whatever the days the reliving early so its same applicable to the companies too if they wants to relive the employees before the actual last date of service? the policy is applicable to both employee and employer? please help on how to take action on this? thanks all have a good day
Regarding reliving letter issue
Hi all i worked for a mnc company for over 2 years and i got a good offer in another company and i wanted an early reliving as per the company norms notice period is 2 months however there is a provision to pay the amount if we want to get relived early. the management is not ready to relieve me tough i am ready to pay the amount after repeated talks with hr and manger they still not ready to relieve me and i informed them that i couldnt continue as i need to join another company. after 2 months my previous company sent me a letter stating i need to pay certain amount and i called them and asked for my relieving letter and they said they will provide my reliving letter if i pay the money i sent a dd to them and they sent me only a letter stating i do not owe any thing to the company as i paid the amount and they gave a letter stating i am relieved they are not providing me the experience letter. i tried calling them and they are doing the same old game to contact my hr and he asked me to send an email to him and after that he is not even responding to the emails or my calls.
Notice period and early relieving
Hello my notice period is three months and i have put in my papers. i had resigned on 1st april 2013 and serving three months notice to the employer which falls due on 29th june 2013 and not asked for early relieving. but forcibly without giving sufficient reason and notice if my employer relieve me before 29th june 2013 then does my employer has to pay me for the difference in the notice period resulting from an early relieving? my contract letter termination clause says "your appointment can be terminated on three months prior written notice on either side. notice pay and other outstanding which may be due from you will be deducted from company dues payable to you on separation and /or recovered from you. thanks pk
Can an employer revoke reliving date after confirming in writing
Hi i had a discussion regarding my reliving with my reporting manager. during the discussion we believed that my notice is 2months. however i requested for an early release to which my reporting manager said i will get back to you after discussing it with hr and hod. upon follow up the manager responded back with a definite date on email. now i received another email from the manager stating that as per the discussion with hr notice period is 3months so now technically its 1 more month and said i didn t check with hr before giving you the relieving confirmation email. based on the earlier reliving date confirmed by my manager i have already informed my joining date to the new employer. pls suggest how do i tackle this situation now.
Reliving from job in probation period - join a new organization without reliving letter?
I joined a organization 3 months back but job role didn t suite so i look for new job and got a better one. i was expecting to get relived within 1 or 2 week as i was in probation period only. but now organization is saying you have to serve standard notice period of 2 months or you have to pay early release. pls confirm is it justified to ask for 2 months notice in probation period. secondly if i join a new organization without reliving letter will be safe for me ?
