Sir, In TNSTC Employee was retired past five years before. At that time an unimplemented punishment amount had not been recovered. Now earned leave cash granted and available in our office. If the punishment amount could be recovered from the employee and balance amount could be paid back to him.

What was the punishment? Who is this employee -an workman? or a manager?
Standing order does not provide any punishment of financial penalty. There could be recovery on based loss to company's property due to his negligence and gross violation of established rules subject to he been given to give his explanation in this regards, if any.

What is this unemplemented punishment? For what reason it was given? Fines can be imposed under the provisions of Payment of Wages Act.

Some states model SO and SO of some establishments provide fine as a punishment.It is always ideal to deduct fines from the salary payable immediately after its imposition.
Of it a fine as per POW Act it cannot be deducted after 90 days.
