Dear All, Please give me clarity on Bonus payment, if employee is on maternity leave and salary paid by esi during the maternity leave, then organisation should pay bonus or not to the employee if the employment of the employee is off roles of the organisation.

Dear Srinivas
The bonus is X% of wages drawn in the respective accounting year. Thus the bonus will ne proportionate to the actual days worked. For purpose of days worked days of paid leave, agreed/approved lay off and maternity leave days has to be considered.
So here the employee has to be paid the bonus for period including Maternity leave.

Thanks for your reply.
There is point in Bonus Act that, the employee has been on Maternity leave with salary or wage during the accounting year bonus need to be paid.
In Bonus act it is mentioned Leave with salary or wage, but employer did not pay, ESIC paid the salary only leave was provided by the Organisation then organisation should pay bonus or not?
Pls reply.
