Hi All,
Can my company terminate / discontinue an employee who is on our agency rolls with immediate effect without giving him any notice period or salary in lieu thereof. It is pertinent to mention here that due to some issues the agency on which rolls the said employee was, is no more continuing with our company. However, some of the employees were retained by my company. for last say 5 months there salaries are being processed by us.

I don't know any reason behind the termination. However, if the terminated person was not on your rolls then there is no obligation on your Co's part to issue any notice of termination. This should be the obligation of that agency's. What was the arrangement to retain some of the agency's employees with you, any retention order was given to them by you? If you are not prepared to take them on your rolls, better engage some other agency for this purpose with due documentation vice the separated agency.
