Factory act doesn't discriminate among management staff - why there's no OT pay to management staff?

As factory act doesn’t say any discrimination among management staff, workmen, contract workmen, why there’s no OT pay to management staff? Isn’t it violation of act?

You may want to read Section 64 in the Factories Act, 1948 along with Section 1(6) of the Payment of Wages Act, 1936. Here you will get the answer why management staff i.e. person holding position of supervision or management don't get overtime payment.
