Dear Sir,
I have recently joined as an HR executive for a factory registered under the U.P Factories Act, 1948 and have been tasked to find out the legal requirement for Leaves as per this act for Staff (not workers). I have read few books on this but the information is not very clear.
Could you please advise me on this and point me to the material that confirms these details.

in a nutshell,
all employees of the establishment who are in muster roll are covered under the act
ask the management for the adopted policies till now and then cross check with the statuary compliance.

Dear Sharma ji,
I have checked this and as per the existing policy, workers who are covered under ESIC are not entitled for Sick/Medical leave, but Staff which is out of the purview of ESIC is entitled for the same.
Management wishes to give all such Staff members medical benefits via private medical insurance such as Religare etc. What impact will this have on their medical/sick leaves. Management wishes to not grant Medical leaves or reduce the number of medical leaves as they are giving a benefit over and above that.
Can they do that as per law?
