Hi HR & Legal experts & other experience members of the community,
I work for a engineering services company headquartered at Bangalore. I joined as a Principal Engineer -2 & recently got promoted as Asst Project Manager.
My offer letter does not mention anything about notice period during exit or termination policy except this:
8. Service Agreement for Onsite Assignments which I may have to sign on such terms, as the company may deem appropriate. This agreement will consist , inter alia, of issues like (i) your commitment to complete the project (ii) your returning to India after completing of the project and serving the company for a stipulated period.
pfa the snaps from offerletter ,separation policy & HR policy & Travel policy wwhich relate to notice period, exit policy etc.. for reference.
my queries:
1. no notice period point in my offer letter. now should I serve the notice period of 90days ?
2. if I pay 1,50,000 then can I leave without serving the notice period?
3. can the company not relieve me even after 90days of notice period?
4. can I buy out the 90days by paying equal amount of my salary in lieu thereof (not mentioned any where in company policy or offerletter)
5. can I opt for an early release by choosing to forego any salary from resignation date (if relived immediately).
6. if I serve 30 days and not 90 days, i do not want 60 days salary as I did not serve but I expect 30 days salary as I served 30 days notice period. possible?
7. can I simply not serve notice period and not expect any salary from company but just get proper relieving & experience letters?
8. how can I be sure of positive feedback about me by company for future potential employers?
9. what about my PF? is there a way for a smooth way to get my PF from this employer as its been 3 years with this company.
10. can company force me to stay beyond 90days of serving my notice period?
11.can I buy out the notice period by paying some amt to the comapny if so how much? is it the same 1.5 lac? but it was for onsite travelled employees if not serving the notice period i guess?
12. company keeps changing policy with out proper consent of employees. this affects a lot during exit. all points are changed randomly and not helping the employee.
13. new policies shall be applicable to employees who joined before the policy change date as well?
please advise
any info in case required additional about this can be shared upon request. all employees are either stuck here or unable to grow in their career due to such nonsense in the policies .
