My client is interior contracting company and they have ESI/PF for their regular office staff.
While awarding work for subcontractor without ESI/PF number for job work :
In case of scrutiny :
1. Will ESI/PF be liable on the entire labor bill raised by the subcontractor?
2. Suppose there are only 4 workers who worked for a month for the subcontractor and ESI/PF has been paid for all the 4 workers...but his labor invoice value is 250% more than actual wages, is our liability on the entire labor invoice value or is it null because we have site attendance register for all 4 employees and we have paid already paid ESI/PF for them.
3. For subcontractor job work, should the labor invoice be equal-to / proportional to actual site wages or can that differ? The payment is being made with TDS deductions.
