If payment is being made on Daily basic then only they are not eligible else they are eligible.

First of all check whether there is a National Holiday Act in your state and if it is so follow the provision. Otherwise see the Standing Order provision. To not to pay the Daily Rated workers is discriminatory and may not be upheld if challenged in court.
