Hi everybody the charter of demand is still pending to settle. management has offerred the best with compare to last 10 year settlement and also best from the surrounding industry but still it has not settle. workmen may go for strike but situation is very difficult to be predicted. my question are can workmen go for strike without any prior notice?? can they stop the contract labour to work in the factory?? when can be say the strike is legal or illegal?? can we take the help of the police if they force the other labour to come inside the factory jks
Company has lost original document and breached the contract
Hi sir my current firm has lost my original 10th class marksheet which they had asked as a proof of contract. they have mentioned that i will be placed in the new delhi office however i was placed in gurgaon which is in haryana. is it correct that besides saying that i will be based in new delhi office i am based in gurgaon though i understand that new delhi office can be any where but can it be placed in another state? i am supposed to work at the new delhi office which is located in haryana does this make sense? what all laws have they broken apart from this being an integrity issue and what can be the outcomes of this? in the contract they had said that i will have to work for one month and give away my full salary if i leave before a year. i decided to quit and then i was told that i can collect my document at the time of full and final settlement. when i asked for the document as i had to present it somewhere else i was told that the document has been lost. they s
Use of contract labour in core activity / production
Hi during an audit we raised objection to use of contract labour in direct manufacturing work in a factory in maharashtra on grounds that it was a core activity and work is of perrinial nature. as such these jobs must be done by employees on the company s payroll not by contract labour the factory manager has responded as be low : there is no bar in maharashtra state under the contract labour act on employing contract labour in core or production related activities. further they do not work under the direct supervision of company employees. hence they cannot claim permanency in the company. we know that this is not allowed the work is supervised by floor mangers but can t find the section rule or provision that counters the above argument. i will appreciate help from my colleagues on the site for any inputs on this matter.

Hello my sister s employer is not providing the exit papers experience letter and relieving letter and asking to sign a legal document forcing to work in parallel with other organization where she has newly joined. she worked with them for a few years and they were mentally harassing her overtime less pay taking advantage of scenario and so on. she has served the entire notice period and whatever they have asked to complete from project responsibilities to everything. the new employer took her on a new job with a condition for submitting the paper as soon as possible. she does not want to have any working relations with this previous employer and because she was good at work they were not letting her switch the job in past and now asking to sign a legal document forcing her to work with them otherwise they will not release the exit papers? can you please help how to tackle this? its been almost 2 months requesting them for the papers. what legal actions i can take?
Sub contract with in factory premises
Dear all i need expert advice to attend below query x company registered under factory act give major job work to a company registered as a principal employer under contract lab act at factory premises of "x" a company distribute work to 10 different contractors for completion of job and all contractors has taken labour license based on form 5 issued by a company and maintaining all records as per cl act. during visit of factory inspector he demands the license of contractor directly on name parent company x instead of company a. under cl act there is no provision of sub contract. kindly guide what is correct provision for such type business situation and what stand company x will take to avoid any non regards
