We are a sheet metal fabrication unit with Press machines predominantly in Pune Maharashtra.
It is unclear if our organisation falls under Factory act or Engineering Industry.
1) Could someone please help me clarify the difference between the two?
2) Could this be established by some authority, stating which industry I belong to, to ensure that I am compliant with the law?

You have started as an Engineering Industry, and once you continuously (240 days) engage 10 or more workmen with the aid of power, you will be covered under Factories Act. Factories act prescribes / regularize the plant / machinery lay out, and safety & welfare provisions. For wages you are governed by the Minimum wages payable for Engineering / Fabrication industry. Engineering Industry is one of the category of Industries, in Factories Act

Thank you Mr Babu. Just to clarify, I would like to know if I fall under Residuary Under Factory Act, 1948 or Engineering Industry.

it mentions that erection, assembling of equipment like automobiles, transformers using scientific technology fall under Engineering. Do press machine operations also qualify for the same?

Right fabrication unit with press machines....undoubtedly yours is a factory....and now factory definition is widened....it covers even a petrol bunk.as a factory.so why not yours... Engineering industry is nothing but all engineering works ...surely by machines..Every factory should have machines...and producing new useful products....ur establishment is a factory producing metal sheets by pressing machines. Whether any repairs or vehicle washing units that have machines and some manual engineering works. are all comes a factory....so go ahead with labour laws and other dept.laws of factory. All the best...undoubtedly..

Small correction. Maharashtra Factories (Amendments) Act 2015 the Factory Act is applicable in Maharashtra. If the manufacturing process is carried with the help of 20 or more workmen with the aid of power or 40 workmen without the aid of power respectively.

Every state has some minor amendments but the concept behind the Factories Act is applicable to all such factories.
All scientific process industries and even bio-products and ayurvedic health producing units natural face cream manufacturing units, pickles manufacturing units also come under factories act definition either with number of workers or with m1,m2 types of categories of using quantity of electrical energy. (look and find in factories act in google pls).

Factory and Engineering unit difference...no difference...All factories have engineering works. So all engineering working units are undoubtedly factories.
Your version defend that we have lathe welding and press machines and we are doing with hands like handicrafts. and allied works of a factory...like assisting units manufacturing some bolts.. casting works etc. Suppose a car factory all parts can't be manufactured by its own premises...Its allied units of enguneering works made many and comfortably satisfied and used by car company. I think all can't be write here... May be understood.

Thank you for your inputs, and I apologise for persisting with the topic. So for the MMW act, do I need to register under Factory act or Engineering Industry?

Sir take a factory act license of your area officer..and be happy..follow workers safety and welfare measures. That’s all

Sir I feel that this forum is not meant for learning basics of labour acts...I feel that here there are extra ordinary genius members lift the blocks and safeguard worker's rights and encourage good HRs and employers to avoid struggles with workers.. Only when employee or HR or Employer should make some steps in implementing labour laws then if they find any difficulty forum members co ordinate in finding right way..
What I feel is quiery people should do some homework on the labourlaws like google or names of labour laws read it follow ...implement .,talk with your company lawyer then ask clarification.. That's the right way of using this forum.
If not people msg me and asking what is minimum wage..? I am surprised a big company hr person asking like that.. If you don't know try google or any labour manual on mw act...forgive me if iam wrong.pls
