I have a small query about the Payment of Gratuity, i worked with a Company last 5 year 6 month and 6 Days
My Date of Joining is 29 oct 2012 and last date of Working is 05 may 2018 - Basic + DA is Rs 34912,
Kindly Calculate the amount as per the Payment and gratuity Act Compliance.
My Query is they are providing me the Payment of gratuity with the calculation of 5.52 years but as per my Knowledge
They should be pay my 6 years of gratuity for my tenure, Kindly Clear, are they complaint or non complaint?

Dear Friend,
As you have completed 5 Year 6 Month and 6 Days in organisation. Since it is more than 5 and Half Year you are eligible for Payment of Gratuity for the period of 6 Years.
Calculation of Gratuity is
[(Basic + DA)/26]*15*Number of Completed Period in the Organisation
In your case it will be
[34912/26]*15*6= Rs. 1,20,852.00 (Rs. One Lakh Twenty Thousand Eight Hundred & Fifty Two Only)
Thanks a lot , your answer will help me, but where it is mentioned that, Gratuity will be round up after Completing 5 years and 6 month.
Because My Company is not satisfied with this,and they are Providing me only 5 years and 6 month gratuity instead of 6 years.

The company's stand is incorrect. You may approach Labour commissioner's office and submit representation attaching relevant documents.

i m working in a pvt ltd firm and i joined company on 11 Nov 2013 and leaving company on 31.08.18 will i am eligible for gratuity as there is 6 days working and no LWP /LOP in my tenure.

As you have written that there was no Leave Without Pay in your Job Tenure.
Date of Joining- 11.11.2013
Date of Leaving- 31.08.2018
As per my calculation you have completed 4 Years and 252 Days of Physical Attendance in 5th Year. For eligibility of Gratuity 5 Years of completed service is necessary. In 5th year your Physical Attendance is 252 Days which is more than 240 Days. Since you are eligible for Payment of Gratuity.
