Hi friends i have a query regarding employment termination notice. in most of the companies specially it both employee as well as employer need to give equal number of days notice for example 60 days before terminating the employment. but is it possible that employer ask employee to give 60 days notice but he himself employer give 30 days notice to employee? is it legally correct? if this employment term is already discussed with employee during joining and is mentioned in his appointment letter. will then it will be ok ? please guide me on this. what is legal terms for notice by permanent employees. thanks for your support in advance. meenakshi
Termination without any reasonable cause - how can i get a stay on my termination letter?
Sir i have been terminated with the notice of termination in two months in advance without any reasonable cause which as per the contract is right. no written reason was given. i just want to know that how can i get a stay on my termination letter. i also want to send a legal notice to the school to state the reason of termination in writing.
Not getting notice period pay on termination
My company startup of 40 people terminated my employment last week abruptly without any prior written or oral warning. the reason cited was nonperformance. they are also saying that they will not pay me the notice period pay which was 2 months as was mentioned in the employment contract. it said if i resigned i had to give 2 month notice and same was applicable for company on termination. that is if they terminate me they will pay 2 months of salary. there have been 4 similar precedences in last 4 months and they have paid everyone 2 months of salary i have that proof as well now in my case they are creating an exception. my questions are if i take this to court can i get my two months of pay from them? are there any things/clauses that may hinder this i mean can they forge any information or do something unethical to win the case ? typically how long such cases last and what is the fastest way to resolve this? thanks in advance

I want early release but they are not ready till my replacement is done .even i am ready to pay shortfall in notice period but not agreed . these are the term and condition let me know what can be done . notice period/ separation: your employment with the company can also be terminated either by the company or by you by giving the other party three 03 months advance notice. if the company terminates the employment and decides to relieve you before the completion of the notice period the basic component of the salary for the balance notice period would be paid to you by adjusting the amounts payable by you to the company. for the avoidance of doubt all amounts payable by you to the company would need to be cleared forthwith in the event of such termination. if at your request the company agrees to relieve you before serving the full notice period you will be liable to pay the company the basic component of the salary for the balance notice period along with other amount payable by you to the company if any. however please note that accepting any such early relieving request would be entirely at the discretion of the company. on termination of your employment for any reason you shall comply with the companys termination procedures sign all documents and return all company property. the company will not be bound to pay the dues if any till you have completed all the separation procedures.
