Dear Babu Alexander ji,
Happy to note that you are a retired person, you are in early 70s and still you are active spreading /sharing / enhancing the knowledge you have. May God bless you with good health and long life.
I am pleased to know that you are prepared to correct yourself. We learn from this kind of attitude.
In fact my answer to query is there in post #3 above.
Though PF Act is applicable to those who have Basic and DA less than the threshold limit i.e. Rs.15000/- at present, but there is a thumb-rule that "Once a Member, Always a Member". You can not be excluded from PF on crossing the Basic and DA more than threshold limit.
Even you join new employment and your Basic and DA is more than threshold limit at joining, you can not be excluded from PF since you are in PF with your previous employer. Form 11 is taken from employee at the time of his joining only to see his PF status on joining so that he should be admitted in PF or not.
Employee joining with less than threshold limit is compulsorily to be taken in PF.
Employee joining with more than threshold limit, he is to be taken in PF compulsorily if he is in PF with his previous employment.
If he is not in PF with his previous employment or he is a fresher and his Basic and DA is more than threshold limit, it is not compulsory to take him in PF. However, if employee and employer both are ready for PF contribution, the employee can be taken in PF. In this case contribution can be restricted to threshold limit or it can be on actual Basic and DA at consent of both employee and employer.
In the query in current thread, the employee is continued to be in employment with same employer without any break, there is no question of stopping his PF contribution because his salary is crossed the threshold limit on change of his assignment.
Hope you will appreciate my answer.

Thanks sir for your valuable input. That will surely helpful for me a lot. Though I have taken that employee as part of PF, now I am changed by some other fellows who are debarred from getting the benefit. Thanks a lot.

Dear All,

Multiple opinion given on above discussion how ever wants to put my view to clarify everyone.

1. PF department passed a gazzete about PF Membership and Opt out from PF wich is effect from 01.09.2014.

2. A member can optout from PF if he is newlyjoined the Organization after above date and his Basic+DA salary is more than 15000/- per month.

3. If the above member wants become a member of PF his total contribution ( 24%) will be goes in PF account. He is not eligible for pension.

4. considering the question of Tirilee-Praharaj, as the empoyee is already member of PF and Pesnion during in earlier days, after promotion also he is applicable in PF as well as in pension. Please continue his membership in PF and pension otherwise your orgnaization will be fail conseqence if any audit done by PF office later on.

Above views given based on my knowledge and expereince ,if you want connect with me for any support feel free to contact @ 8308261566.

Regards
Durga Prasad
