Our's is a newly setup JV with registered office at Mumbai ,with promoter companies being PSU ,has the following manpower :-
a. 5 contractual worker (employed under handling/security contractor and complying to PF norms)
b. 8 employees on deputation from promoter PSU companies ( Salary and all other HR compliance by parent company) and billed to JV c. 5 employees aged 60 plus on contractual assignment directly under the JV in senior position .
d. 2 contractual employee on temporary assignment directly under the JV for clerical work (receptionist/office assistant) with monthly
lumpsum payment of 30 thousand
My questions are as below
1. Is Registration under Shops & Establishment Required ?
2. Is PF registration by JV / deduction of PF required as far as those under serial (d) mentioned above .
3. Will employees on deputation from parent companies to a JV be considered under employee strength of the JV as far as the definition of establishment goes ?

In my opinion,
1. Is Registration under Shops & Establishment Required ?
Yes. The Office premises has to be registered under Shops and Establishment Act within 12 months of commencement.
2) Is PF registration by JV / deduction of PF required as far as those under serial (d) mentioned above .
Provident Fund applicability is from the date when you cross, 20 or more cover able employees ( employees drawing Rs.21000/- or less) , including directors. Register through PF Portal. Similarly for ESI also.( wage limit is Rs.15000/-
Will employees on deputation from parent companies to a JV be considered under employee strength of the JV as far as the definition of establishment goes ?
