Seeking advice on a recent issue I am facing. An employee has just returned back to work after maternity leaves and has resigned from the job stating that it is difficult to manage a job and a new born baby at the same time. As per law, should she be relieved from duties as per normal process or is she liable to pay back the monetary benefits that she has received (in terms of salary) during the maternity leaves?

Dear Anubhuti ji,
Maternity leave is a right of women and accordingly she availed it. After availing the leave she resumed her duty and resigns, then where is the question of paying back the benefit availed? Mr. Sivaramakrishnan answered you rightly.

Thank You for clarifying my doubts Mr. Sivaramakrishnan and Mr. Korgaonkar. I hold the same views, however, needed some opinion to back my own opinion if such a discussion comes up with top-level authorities.
