I m a senior pro with 25 yrs exper ,was working in a gold loan company in Kerala.resigned in mar due 2 variousharassment especially non confirmation after 1.5 yrs work. Very next day they started threateningme for which I left immediately without notice. i also wrote all this 2 hr but they obviously denied all allegation agnst md 2 whom i used 2 report.but in my 1st letter of resign I had mentioned 3 month notice which they don't accept N dint release. Now as per co policy if not confirmedin writingI shall be on probation.they dint confirm as I said.offer letter is silent on notice period for probationers.only says notice period is 3 month.now after 1 month I get show cause with many issues like dint give Sal slip of prev company,am to showmy bank statements to prove I hv not embezzled(I hvnt, in a pub Ltd company run by promoter none can issue any p.o. or vendorisn't gullible +a probationersdon't have power to do anything even if senior)
Now what to do? Why shud I hv to reply to show cause in 7 day n justify? I know they may take legal action otherwise.but can u show cause a probationer who resigned 1 month back?what kind of rule is this?they're even saying I m absconded while they know I hv recd their letters! M I bonded Labour that only my employers can release at their sweet will? Tremendous harassment after all these years of clean corporaterecord!very frustrated with Indian system. shud i goto media as the company is large?Employers can also drag u to court long after resignation to derive vengeance or for fun? Also can u publish a circular on intranet n claim consent?offer letter doesnt say so.and can u serve notice via email n not regd letter? Pl help.

Make it into neat paragraphs and then ask what you want from forum members.
SMS language is confusing and avoidable especially when you want advice on an important matter.
Suitable advice will be rendered if you put up a proper query.

I was working in a Sr position in a gold company in Kerala.in 1.5 yrs I hv not been confImmed in writing.offer says till confirmed in writing I m probationer.hv resigned a month back.now company is sending show cause notice with bogus claims n says they hvnt acceptedmy resign.notice period is 3 month but doesn't mention about probationers. can they now show cause me n must I reply? Who r they to not relieve me? Is a probationer to give 3 month notice mandatorily if it's not explicit in offer? in fact their probationer clause says they can terminate me anytime.isnt then it is assumed to b reciprocL?Pl help.

When you resigned did your company accept it?
What is the notice period company has to give for termination during probation?
Same period is the notice period for employee if he wishes to quit.
Discuss the whole matter with an advocate who works on labour cases and send a proper reply.
