I want know one thing please help me, My question is:-
We have a trading company FMCG and we have total employee's is one thousand plus. We have one CA is Female. She wants her Maternity leave from st May-2018.
and total salary is 45000 and basic is 20000. So please suggest me how much pay at Maternity Leave of her in this case.

If she has been working with you for 12 months with at least 80 days working days in this 12 months, she will be eligible for maternity leave of 26 weeks plus a payment of Rs 3500(one time) as medical bonus. This medical bonus is not required if you have arranged for her prenatal and post natal care. This 26 weeks leave should be paid leave at the same rate of salary that she has been drawing, ie, Rs 45000.

If company pay her only Fixed Basic ?(20k)

I didn't get your question. I have said that if her salary is Rs 45000 with whatever basic pay, she is entitled to get Rs 45000 for 26 weeks. Now you are asking if her basic is only Rs 20000. Why? If you want o convey that her fixed salary is only Rs 20000 and the rest is her performance incentive which is variable, then okay you forget about that variable part and pay only Rs 20000 each month because during her leave days she will never perform and hence she cannot earn any incentive. But here my apprehension is why should a Chartered Accountant be paid variable pay? Is it really possible to evaluate an Accountant's performance month on month?

Hi,
One of my employee is wants to avail maternity leave, so i want to know whether she will be getting paid from ESIC and our company also or any one of this? As per my information i told her that she will be paid by either one of this, but still i want to know about it.

If covered by ESI she will be paid from ESIC and i not covered by ESI,you will have to pay benefits
