Dear all
I have given my resignation in my company on aug-2017 and want to be relieve Sep-2017. In my appointment letter it is clearly mentioned that you have to give a notice period of 30 days or pay the basic salary for 30 days. as per there rule i served 30 days notice period in that notice period they are not giving any replay to my resignation and remainder mail also and i stop going to office on 30th day onwords after few weeks i am asking about my reliving and experience latter they are denying to give from last 4-months without any reason and finally i went to the police station when SI called to the HR he said i will give immediately after going to the office come tomorrow i will provide you required documents. after some time he called me again and saying i am investing money on your training like that i am put case against you but i do not received any mail or notice from reliving time about training today he saying this reason after 5 months but actually training got completed before 10-months and they are not giving any training he just mentioned in offer latter only and now he's telling i am put a case against you.
now i dont understand whom mistake this if i proceed with police what will happen and what proofs i have to provided to the police to prove they are playing games with my career
please suggest me now what i want to do and not to do

Please check your probation period and after successful probation your confirmation of employment in written has to be issued by the company. You may also check whether you have been provided any training by the company during your tenure. If your employment is not confirmed in written it is meant that you are still in the probation period. In this case you can refer to the clause of probation and the exit procedures of the company.
As per the supreme court order no one is permitted to harass any employee mentally or physically while in the employment or after the exit of the employment. To get the experience certificate and other clearance from the company is your right.
You can send them a letter from a Legal practitioner stating all the clauses as stated above after due verification so that they will understand the seriousness of it. Later on you can file a petition with the labour ministry alongwith the copy of the letter. The letter may be sent on Registered Post as it is a legal proof of delivery.
