I am having H1B visa stamped in Oct-2017,I-797 and original petition documents with me but did not travel to US on H1B yet.But due to some urgent family requirements,I resigned in my home country(India) and my employer is threatening me to submit original petition else they won't give releaving/experience letter. How legitimate it is for an employer to force an applicant to submit her original petition even though is awarded by USCIS to me How can I get rid of it without handing over original petition,Kindly suggest ?
NOTE: I've not signed any bond or documents where it was mention that if I leave company in any circumstances then I'll have t submit original petition.
