Company doesn't have maternity leave benefit
Dear all need few suggestions from all respected knowledgeable person. i ve joined a startup retail company as a hr manager to setup hr department over there. as per the shop & establishment acts and as per the labour laws i am making hr policies. i want to include maternity leave benefit into the hr policies but management is denying to provide maternity benefit to their female employees. my concern is if a female employee become pregnant and worked above 1 year in the company and company does not have maternity leave benefit. can she avail maternity benefit as per the maternity benefit act. kindly guide me on the same. waiting for your valuable feed backs & suggestions. thanks & regards shubhangi shah
Maternity benefit : applicability to a pvt. company's branch office having less than 10 employees.
Hello everyone my friend s wife has been working in a pvt ltd company registered in mumbai but has branch office in karnataka which has less than 10 employees. she has been working there for over 4 years as regular employee. the branch office comes under shop and establishment act. though the overall staff of the company on pan india basis is more than 200 employees. is she entitled to maternity benefit? the employment contract does not provide the maternity benefit and there is no employment handbook. i would be very thankful for your advise on the entitlement.
Maternity benefit under esic.
Dear fellow members i have one query related to the maternity benefit under one of our female employees is covered under she is pregnant now. but in her two years of employment with us she has not taken any esic benefit or even taken tic. she went on leave by just giving simple leave application of prolong leave. meanwhile we have arranged tic to provide her maternity benefit. which tic not reached to her. as per my knowledge she need to visit esic office once before edd to get the benefit. but before that we came to know that there was a miscarriage. kindly advise that if she is still eligible for the said benefit under esic ? thanking you in advance. maulik dave

Dear sir/madam one woman employee joined before one month now she is in pregnant and request us to provide for maternity leave under maternity benefit act 1961. at the time of joining itself she was in pregnant. but that time she failed to disclose this matter. now only she is intimating to us. her working days are very less. because she joined newly in our company. is she eligible for maternity benefit? please clarify above things. thanks with regards thirumurugan

Hi we are in the process of updating our employee handbook. we are a uk based company and follow most of the policies & practices of the uk. the present debate we were having is on maternity benefit. in the uk they have a maternity benefit for 52 weeks . 25 of these weeks are full paid leaves and others have partial payment. as per indian standards we need to pay only 12 weeks maternity benefit to the female employees. do most of the company s have just 12 weeks maternity benefit or they extend this beyond 12 weeks and provide longer leaves to the employees? please help me with your experiences. i would also like to understand what is the practice in bpo industry as well. thanking you. best regards sonia
