1. Sir, you can approach the Regional Director or Joint Director of the Region/Sub-Region of ESIC to which your unit is attached, explain all the position in detail as to how you deposited the contributions through error etc. You can either demand for refund, or can also demand adjustment against future deposits, if due.
2. Since ESIC is a stuatutory organisation based on some statutory provisions, I think, there will be no problem for refund or future adjustment of excess contribution paid if it is found that the contention of the employer was correct.

Sir, please see Regulation 40 of ESI (General) Regulations, 1950 which is regarding "REFUND OF CONTRIBUTIONS ERRONEOUSLY PAID". You can submit application for refund to ESIC under provisions of above regulation.

I agree with views of Mr. Harsh K Mehta.
There are provisions of refund and adjustments in ESIC if paid more erroneously. Approach your RO/SRO along with all details. Normally the excess amount is adjusted against future payments. You can adjust the excess amount against next payments and pay the balance amount. Then intimate Revenue branch officer of your RO/SRO accordingly.
