What should be the revert to the employee.
If we need to give advance leave then for which reasons it should be accepted.
If the employee leave the organisation after giving advance from tomorrow - 14th Dec '17. And after that recovery is problem!

Frame good leave policy.
Take into a/c laws of the state, centre and similarly placed industries in same field.
Advance leave when there is no leave at employee credit may become problematic.
Employee can be sent on leave without pay for this period.

Practically and technically speaking, it is not a sound practice to give advance leave to an employee when he did not earn it. You can give leave on prorata basis if he earned leave in the current calendar year but the same is not credited to his leave account.Otherwise, he can be sanctioned LOP.
