Dear Community, I am working for a construction company in Telangana. We are awarded a new project by govt. of telangana. The labour department is asking for a joint undertaking by contract and employer for payment of minimum wages. Please let us know, is there any section in Contract labour act or minimum wages act wherein both contractor and employer has to submit an joint undertaking.

The payment of minimum wages to the contract labour primarily is that of the contractor.However,sec.21 of the Contract Labour Act 1970 requires the Principal employer to pay the wages to the contract labour if the contractor fails to pay them.Therefore the Labour commissioner must be insisting on joint undertaking.
