Recently Supreme Court has given decision in favour of employee for EPF pension hike around 10 times. Now can we contribute 8.33% towards EPF pension without any ceiling and who has already retired recently can get this revised pension after paying difference in contribution.

Referring to SC decision which has opened the gateway for many covered employees in EPFO and are entitled for EPS raised bar which was based on amendment in the EPS Act in 1996, yes you can file your case with epfo with contributing the difference of amount payable, conditioning that who were the member of scheme before August 2014 as the government amended the EPF act and deleted the provision that allowed the employees to make a higher contribution and draw pension based on full salary.
So check your joining date in EPS accordingly and file the case.

I am a member of this scheme since 1993. I understand that I am eligible to avail this scheme. Please let me know the formalities to avail this benefit and how to calculate the difference amount to be paid now and what would be the pension amount that I would receive after my retirement.

Hi Ravi,
Just submit a request letter to PF office that you referring to SC judgement, you want to contribute your EPS on your full salary mentioning your full details with PF and UAN number. they themselves will update you with details of difference amount to be submitted. Also attache the circulation as attached in this message.

I will be oblige if you could share PF Circular dated 31- 05-17, on the subject pertaining to Exempted Establishments. OR guide me from where can I fetch it.
If I am not wrong the said PF Circular was annulled before various high court ultimately upheld by Apex Court.

Does it mean that the retirees who retired anytime before August 2014 & who had enrolled before August 2014 can give an application to EPFO & EPFO will calculate the difference amount to be paid on full salary & intimate the pensioner & on paying the difference amount the enhanced pension less the already paid pension will be paid with retrospective effect? Will they deduct the difference from the enhanced pension & pay the balance / call for the balance to be paid . I retired in Feb 2007, will I get the enhanced pension with effect from 2007 if I pay the difference of contribution amount? Do I have to pay the difference up front or will EPFO deduct the due amount from the enhanced pension arrears & pay me the balance or call for the difference to be paid in case the difference is more than the enhanced pension amount? I am looking at an option of not paying a very high amount when more or almost nearer to that amount will be due from EPFO.

Thanks for the response, Without Prejudice.I has requested you to share the PF Circular dated 31.05.2017 issued by EPFO with respect to Exempted Entity not eligible for higher PF Pension which culminated in filing the writ petition in Various High Court by Employees of Exempted Trust which is upheld by Apex Court in favour of Exempted Entity employee.

Dear Mr.Agrawal Sir,
I left my job in Dec.2013 & received pension certificate @6500. Served 13 years.EPF was being deducted on Rs.20000 pm. Can you guide what amount I need to pay for enhanced pension? I will complete 58 years in June 2018. How much pension amount I will get after enhancement .
Will it be wise to pay difference amount to get full pension.

Is it possible to apply for Higher Pension to EPFO by the employees who are still working? If yes, please inform me the formalities and procedure.
I will get retirement in July 2019 and before that I would like apply for higher pension and ready to pay the arrears of contribution @ 8.33% on my basic salary for getting higher pension.

I need a small clarification, I am in service from 1995 and has not withdrawn my PF contribution from 1996. I have another 13 years service remaining , am i Eligible for higher Pension contribution and Can I contribute for the same ?

Dear All,
Hi have gone through the same and understand what Hon'ble Supreme Court means to convey is that beside Basic and DA, any other componenet of salary and wages which is fixed in nature will be considered as salary and wages,
Other variable factors of salary will not come under this definition of wages and salary.
so if a company is suppose giving Basic, HRA, Conveyance All. ,Washing All. and Other All. as salary/wages components but all components are fixed so EPF so considered will be on gross salary (including HRA).

Dear Sir,
I left my job in June’2014 after working for 32 yrs ( DOJ June ‘1982 ) in a company managing PF in their own trust at the age of 54.
After that I have worked in companies but no PF deductions was made any where.
Please guide
1. What amount I need to pay for enhanced pension? I have completed 58 years in June 2018. How much pension amount I will get after enhancement considering my pay at the time of leaving job was Rs 50000/- p.m.
2. Will it be wise to pay difference amount to get full pension.
3. What is benefit, If I delay in withdrawing my FPS .
FYI , I have not withdrawn my PF & neither applied for my FPS till date .
