Whether an employee is eligible for el for the period he worked on during any kind of extended probation period?
Hi an employee joined in staff category and was on probation period. his performance was poor therefore management extended his probation for further 6 months. again his performance was examined and found poor and therefore extended his probation period for 6 months. an employee frustrated and left the organization after serving 1.6 months. during the probation period he did not give pl el as per the rule but he left the company after having 3 time extension of his probation period that time he did not get el at least of the extended period. my question is whether an employee is eligible for el for the period he worked on during any kind of extended probation period. please guide.

Hi need your help to sort out the confusion related to leave encashment. guide me to know the provision for leave encashment to employee if he resigned during his extended probation period. my opinion is "during probation employee cannot avail pl however his leave will be accumulate as per company policy or as per act whichever is applicable and will be encash during fnf if he resigned during probation or extended probation." kindly suggest.
Probation period and confirmtion
My appointment states probation for 6 months and may be extended for another three months on ground of assessment of work code of conduct general aptitude and overall suitability. it is also mention that "i will be considered for confirmation in the regular services of the company at the end of satisfactory completion of the prescribed / extended probationary period. it may however be noted that till such time you are so advised in writing you shall be deemed to be on probation" is the above terms are valid under the law?

Termination without assigning any reason
Hi an appointment letter of a company contains the clause of probation period as follow: "you shall be on probation for period of 6six months and the said period shall be extendable but the total period of probation shall not exceed 9 nine months. in case you do not receive any letter of extension on expiry of your initial period of probation it shall be deemed that the probationary period has been extended by 3 three months. during or on the expiry of the period of probation initially fixed or subsequently extended your services shall be terminable without notice from either side." as per this if the employee was not given confirmation letter then his probation period shall extend to 9 months. in this case if the services of the employee are terminated then is it neccesary to give reason for such termination? can u please quote some source/case law also for your opinion?
Extension of probation
Hi friends i have an employee whose probation period has been extended since she has taken 3 days of leave during the probation period. the employee had taken those leave since she was unwell. she has compensated for all of the days by working extra on other days. her productivity and quality of work is above minimum set standards. the company policy states that an employee is not entitled to take leave during the probation period. my question to you is is it right for a company to extend the probation period of the employee in this case. emereen
