Dear sir 1.what is time limit to withdraw resignation letter. 2.what is time limit to accept resignation letter by management. 3.can employee withdraw resignation letter within notice period after accepting his resignation letter by management. 4.can a resignation letter be withdrawn on the last day of notice. 5.can management refuse to accept resignation letter of employee. 6.if management does not accept resignation letter of employee what employee can able to do to relieve from the company. for example: if employee submits resignation letter morning at the same time it will be accepted by management. for this case how employee can withdraw his resignation letter.
Whether the management can deny acceptance of the resignation letter of the employee who submitted resignation?
Dear experts one of the employees is indulged in the theft of company s properties and he is now in interrogation or to say in preliminary enquiry process. in the meanwhile an another employee had submitted resignation of one month notice whereas there is also a suspicion of involvement in the said theft incidence on the said employee who submitted resignation. in this regard i request the expert views on the following lines: 1. whether the management can deny acceptance of the resignation letter of the employee who submitted resignation? 2. is it necessary for the management to accept the resignation and relieve him on expiry of notice period? 3. in the event of the said resigned employee not reporting for work after submission of resignation what would be the course of action to be taken against him? 4. if we accept his resignation whether the management can say in the relieving order that this relieving is without prejudice to reserve the right of the management taking legal criminal action if any in the case of indulgence of theft on employee part is noticed after conclusion of the preliminary enquiry process? 5. any other valuable suggestion please. thanks & regards v sridharan

I am alarmed at seeing a new trend in hr. a few instances have come to my has attention where an employee put in his papers and has stated in his resignation letter that he is willing to serve the prescribed notice period and that he may please be relieved at the end of the said notice period. the hr has very nicely responded by informing the concerned employee that\" we are pleased to inform you that it has been decided to waive off your notice period and you will be relieved with immediate effect.\" and the company is clear and decided that the employee will not be paid salary in lieu of the early release decided at the discretion of the company management. this in real terms tantamounts to \"termination\" of the employee...after all the employee is willing to serve out hos notice period and the co. management is preventing him from doing so by \"waiving of his notice period\" it is very sad that such harsh hr practices are being adopted by employers/hr. i invite comments on t
Problem with relieve letter
Hi i worked for a company. due to lack of opportunities i had put resignation. i got the resignation acceptance. but to get the noc or no objection certificate and get the relieve letter the company is demanding a huge amount in lacks as training cost which should be paid back to company. this was not informed through mail nor i have signed a a bond or document mentioning these terms and conditions. but to give relieve letter the company is demanding the huge amount which is not at all possible by me to adjust. please help me to get my relieve letter from the company. thank you. thanks sandesh

Dear friends i had a doubt on full and final settlement pl advise on the same. i was working in an mnc and i was relieved by the company two months back. the scenario is during my tenure i come across some acts committed by my managers which will spoil the company name and integrity of company. this some how known to the managers and decided to corner me and did all the things which insults me a lot. during our internal discussions i inform them that i was in a plan to resign my job. hence finally as a result of unfair employee practice by managers i decided to send all the issues to top management and sent all information. by the time hr had an oral telephonic inquiry with me and came to know that hr acts in favor of my managers. finally on the same day of inquiry hr and manager relieved me from my service on the same day without giving any notice. our company policy is 3 months notice period by either party or payment of 3 months pay in case of immediate termination. but without giving any reasons i was relieved stating in a mail to me that " my resignation is accepted" . i informed the management that i have not submitted my resignation. but they told that my oral discussion with managers about my plan to relieve is taken as resignation and i was relieved. in settlement management didn t provide me 3 months notice period pay. till now i was fighting for my settlement. pl advice how to proceed is oral discussion relate to resignation can be considered as formal resignation. law relate to settlement. can i proceed with legal actions...
Employee resigned but management did not allow the employee to serve the notice
Dear all i have a query in our organisation if an employee wishes to leave the orgainsation he will have to serve notice period of 60days from the day of his resignation. employee is willing to do so but management do not want him to continue his services. will there be any compensation applicable from management s end as the employees wants to serve his notice period but managment is not allowing him to do so... also he is a sr executive in admin department will the retrenchment compensation applies in his condition? employee has a good track record. please advies.
