Deduction in lieu of notice period
Dear friends i am arun singhal working as personnel manager. as per appointment letter 30 days notice period is required for resignation or 30 days pay will be deducted. my basic is rs 6800/ and gross salary rs 12000/ pm. kindly advise what would be the deduction in lieu of notice period. thanks and regards

Salary in lieu of incomplete notice period
Hi members need some clarification for calculating the salary in lieu of notice period. my appointment letter states that i need to serve 2 months notice period however either party can end the employment by paying 2 months salary in lieu of the notice period. my salary structure has the following heading . 1 . basic 2 . hrs 3 . conveyance allowance 4 . mobile allowance 5 . special allowance 6 . bonus how will the salary in lieu of notice period calculated. what headings of my salary will be considered while calculating this.

Dear all i need your expert advice on notice period to be given by employee/ employer for the separation. in my company presently we are following one month notice period or one month salary in lieu of notice by employee or by management for leaving the job. of late we have realised that one month notice by manager & above is not sufficient for proper handing over or finding the suitable replacement. hence management has suggested to increase the notice period of managers & above to 3 months. i would appreciate if you share your views on the pros and cons of 1 month and 3 months notice period and what is the general concept followed in the industries. is there any legality involved in making such changes and that too effecting existing employees. thanks & looking forward to your earliest response. regards

Notice period during probation your employment can be terminated with thirty days notice or payment of basic salary the basic salary that is mentioned in the salary breakup sheet in lieu of the notice period on either side. after completion of probationary period and confirmation of employment if you voluntarily resign from the services of the company you will be required to give ninety days advance written notice or basic salary in lieu of the notice period subject to the companys discretion. in the event of you having any incomplete work assignment the company will have the discretion to relieve you only at the end of the ninety days notice period. similarly the company may terminate your employment by giving you ninety days notice or basic salary in lieu of notice period. the company can terminate your service without any notice period and without paying the salary in lieu of notice period in case your employment is terminated on the grounds of breach of confidentiality or ip related obligations violation of law gross misconduct material breach of company policy on your part. in such event the company will not be liable to make payment in lieu of notice period.
Relieving without notice in probation period
Hi i have resigned from a organization in probation period without giving notice period. i wrote thrice about my resignation and requested them for acceptance. i was ready to pay in lieu of the notice period. my question is whether it is mandate to serve the notice period when you are willing to pay in lieu of the notice period. the company is not providing me the acceptance and relieving letter and forcing me to serve the notice period. please advice whether any legal action can be taken as per labour laws? thanks
