Dear all,

As all of us are aware, leave eligibility varies for different states. For example, the Maharashtra Shop and Establishment Act stipulates 21 EL with no SL or PL, while the Delhi S&E Act stipulates 15 EL, 12 SL, and PL. Similarly, there are different rules for Chennai, etc.

However, when it comes to implementation, having different rules for different states can be challenging. Could you all please share whether you are following a single leave policy or adhering to state-specific policies for each state?

If your company is registered under different states' Shops & Establishment Acts, then you have to follow different policies for each state, to the best of my knowledge. If your company is registered in only one state, such as Mumbai, then you must adhere to the Mumbai S&E Act for all employees stationed across India.

If you are covered by regulations in multiple states and want to have a single uniform policy across the country, then you need to give the maximum leave granted by all the states. If your company is generous enough, then no problem.
