Dear all need a small clarification on esic deduction and its appilcability below are the queries: 1 is esic is appilcable on the daily wages? if yes. than please let me know the section of the act which have provisions of the same? 2 suppose if a daily wage worker is getting a wage of rs 650 per day and he is earning above rs15 000/ per month than whether esic is applicable for him? 3:is esic applicable for the employees of the company if management has taken the accident policy and workmen s compensation policy? we have a big group working for us and they are paying daily wages to worker and according to them esic is not applicable on them since every worker is withdrawing wages above than 15k in a month? please advise. ranjeet

Dear all i would like to ask that shall pf & esic is applicable for who is working on daily wages basis. as there is a lot of turnover of employees. how can the employee get hi benefits as he changes the job daily or weekly.

Hello please inform if some workmen visit factory and do work on job basis or contract basis and not on daily hour basis like painter working on sqft basis fabricator making shed on weight basis is esi or pf applicable to the company where he does this job ? since workmen employed by painting contractor or fabrication contractor changes and there are no fixed workmen on whose name eisc and pf can be paid? best regards s. desai

Loosing business - contractors have started insisting on providing pf / esic registration
Dear sir/s i am a proprietor working as contractor and carrying out some special activity mostly in construction / interiors sites. my scope of work is not continuous at any one site. i get a work order for the work on a per square feet rate basis service tax. it normally gets over within a week. sometimes in one to two days also. i do not supply any material. i have employed 8 people for this work and their average monthly payment is approx. rs. 23000/ plus including travelling allowance. i have taken a workmen compensation policy. recently most of the developers /builders / interior contractors have started insisting on providing pf / esic registration details and monthly payment challan copy. please guide if registration under pf / esic is applicable to me. i have tried to convince them that both pf & esic are not applicable to me as the number of employees employed by me as well as the payment made to them is beyond the limits as prescribed by pf / however i have started loosing my orders as i am unable to provide the required registration details to them. in such a scenario what are the options available to me? is there any provision for small contractors like me? is it mandatory for me to take registration? is there any exemption which i can avail? is there any composite scheme wherein i can pay a certain amount per employee? please guide sm balaji

Sir we are registered under factory act having pf esic registration have 4 labour supplier contractors at palghar food processing factory we paying salary as per minimum wages act deducting pf esic mwlb pt etc as per prescribe guide line under applicable law. recently we appoint new ca he advice us why you paying such a good amount under pf esic mwlb etc better you can appoint each person as a individual contractor to save good amount it s possible ? can we appoint each unskilled worker skilled worker as a contractor ? if yes how? what is impect under pf esic gst it law ? regards
